PURPOSE AND SERVICES
The Trading platform is designed and acts as an online platform where the Seller (s) can offer their digital goods to the Buyer (s), and the Buyer (s) can purchase them directly from the Seller with the help of the Administrator as a guarantor on the transaction.
Despite the fact that the site adheres to the list of prohibited/ restricted goods and actions that must be strictly observed by users on its online market, the Administration does not and cannot be responsible for the content provided by users, including copyrighted content.
The User understands and confirms that the Administration acts on behalf of the Buyer, and that the Administration serves only as an intermediary for the Buyer and cannot be held responsible for the possible actual and/ or legal consequences of the Seller and other third parties fulfilling the Buyer's order (for example, some Games may provide game sanctions for certain actions; the Administration does not study and/ or check the rules of the Games and does not check the actions of the Seller, including those related to the Agreement, for compliance with the rules of the Games). The Administration is responsible only for the proper performance of the actions ordered by the Buyer by third parties, but not for their effect or result.
The Administration does not own or sell the products/ services published on this trading platform, and does not participate directly in any transactions (grocery or payment, or any other) between the Seller (s) and the Buyer (s), but only serves as a venue. Thus, the Administration does not enter into contracts with either the Seller or the Buyer and does not control the quality, safety, morality or legality of any aspect of the listed goods, the veracity or accuracy of the lists, the Seller's ability to sell goods or the ability of Buyers to pay for goods/ services, complete a transaction or return product.
The Administration is not responsible for the transfer of ownership from the Seller (s) to the Buyer (s) in relation to the products sold on this platform.
The User can access the site through any device that has an Internet connection.
The User must always comply with any operating procedures, requirements or guidelines regarding the use of the site that are provided or available to the User by any means.
The Administration is not responsible for the content provided by the Users. Users must adhere to the list of prohibited/ restricted items and actions.
The User is obliged to carefully read the Agreement and other rules and instructions regarding the provision of Intermediary Services by the Administration.
To place an order, the User selects the necessary service through the form on the platform and fills in all the fields marked as required. Among other things, these fields will contain the significant terms of the transaction. The Administration has the right to deviate from these conditions only if this does not infringe on the interests of the User and does not entail additional costs for him/her. In relation to conditions not specified by the User, the Administration has the right to act at its own discretion.
By sending the completed form to the Administration, the User gives his/her full and unconditional consent to comply with the Agreement and other conditions for the provision of services by the Agent, as well as the terms of transactions selected by the Buyer when filling out the form (nature, volume of services, their cost, etc.) according to which the Administration will conclude transactions with third parties in pursuance of the Agreement.
After sending the order form, the Buyer makes payment at the specified rate. The specified amount of payment is sent by the Administration to pay for the actions of the Seller under the transaction concluded with the Administration in the interests of the Buyer, and also includes the remuneration (Commission) of the Administration under the Agreement.
ACCOUNT
The User must register his/her account in order to use the services provided by the platform. The User is responsible for maintaining the confidentiality of the Account and password in order to prevent unauthorized access to it by a third party, and the User agrees to accept responsibility for all activities under this account. The Administration reserves the right to refuse service, close the User’s account, terminate the user's rights to use, and delete or edit the content at its sole discretion.
Registration of the Account by the User after the registration procedure means full and unconditional acceptance of these Terms the Copyright Policy and the Privacy Policy by the User.
The Administration provides Accounts for both the Seller (s) and the Buyer (s). Under certain circumstances, the User may be required to go through verification procedures in accordance with our internal policies and provide any additional information and/ or documents related to the purchase/ sale of goods/ services and transactions with products.
In case of insufficient reliability, the Administration may terminate these Terms and/ or the Account without notice.
An account can be registered by any person who has the right and ability to use the Services provided by the trading platform, and has no prohibitions or other legal prohibitions on access or use. A person cannot use the platform if they are under 18 years of age.
The account requires the User to provide and use his/her email address and a strong password.
The User is fully responsible for all actions occurring under his/her Account, including any actions taken by persons to whom the User has provided access to the Account, if this has been done. The Administration reserves the right to suspend or terminate the Account of any User who provides inaccurate, incorrect or incomplete information or does not comply with the requirements for registering an Account or with these Terms.
The User has the right to cancel his/her Account at any time.
If the Account is canceled: it will be deactivated or deleted; all rights granted under the user account terminate immediately; and all data and content of the User may be deleted.
PLACEMENT RULES FOR SELLERS
Commodity items should be placed in accordance with the following requirements:
-Make sure that the title, description and image are consistent and up to date. All information must be true and accurate.
-One product or service can only be created within one position. If two or more of the Seller's products contain the same or identical image (including the same image from different angles), title and/ or description, such product is considered a duplicate and must be removed. Please note: the exception can only be made for products with the same image and/ or description, but containing their distinctive features in the title (for example, size, product model, etc.).
- Respect copyright, patent law, commercial secret, and other intellectual property rights.
-Post only those images, texts, videos, drawings of which you are the author or owner. Otherwise, you may post third party content if that third party has authorized you to do so.
-Products/ services posted must comply with applicable law, including advertising and marketing provisions.
-Please observe the list of products/ services not allowed to be published on the trading platform.
The Administration has the right not to post goods/ services if:
-The name and description of the item contains a meaningless set of symbols or keywords;
-The posted information contains external websites, except in cases where a third party is a party to the provided product;
-The information contains any elements/ codes that change the design of the element and the web page and/ or control the browsers of other users;
-The text of the announcement of the offer contains words in CAPITAL letters (without abbreviations) or text with letter spacing (words typed with spaces between letters);
-The text contains many grammatical errors or transliteration descriptions;
-The rules for placing items are violated;
-Posted products are misleading to end users/ buyers, for example, price and availability are not relevant; the image and description of the product/ service do not correspond to reality; etc.).
It is strictly prohibited to sell and buy these items:
1.Fake or illegal items, stolen items; elements that contain inaccurate, false or misleading information.
Items prohibited by applicable law, or those that contribute to illegal activity, pornography, adult material, material that incites violence, hatred, racism or which is considered obscene, licenses, including replicas and novelty of items and any counterfeit products, or unlicensed illegal lotteries or gambling services (including, but not limited to, use or participation in illegal gambling houses), unregistered charitable services, items that encourage or facilitate illegal activities, prepaid debit cards or other stored value cards that are not associated with a specific merchant and are not limited the purchase of specific products or services, products or services that infringe on the rights of third parties, products/ services related to multilevel marketing, pyramid or Ponzi schemes, matrix programs or other get-rich-quick schemes or high-yield investment programs, goods or services that violate the intellectual property rights of a third party, not coded/ incorrectly coded games, promotion time. We reserve the right, in our sole discretion, to add prohibited transaction categories by adding such categories either to this agreement or to the acceptable Terms of Use Policy posted on the Website.
2. It is strictly prohibited to trade with individuals or entities offering illegal gambling, including but not limited to illegal sports betting, casino games and poker games. The Company may suspend or terminate the User's account at any time if it believes that the User is directly or indirectly using or used his/her Account for or in connection with illegal gaming transactions. This list is not exhaustive, and the User is responsible for ensuring that he/ she does not use the services of the site for actions that may be considered illegal in the jurisdiction of the User.
3. The User cannot use our services if he/she lives in certain countries. These countries will be listed on the website and updated from time to time. This list is not exhaustive and we may, in our sole discretion, decide to discontinue or restrict our services in other countries at any time and without prior notice. We reserve the right to suspend or terminate the User’s account at any time if we reasonably believe it is required by law or to comply with recommendations made by an appropriate government agency or recognized authority for the prevention of financial crime.
4. The User is strictly prohibited from using his/her Account for any illegal purpose, including but not limited to fraud and money laundering. We will report any suspicious activity to the appropriate law enforcement agency. The User is prohibited from using his/her Account to attempt to abuse, use or circumvent the restrictions of use imposed on the products/ services sold/ purchased.
5. The user, and not our responsibility, warrants that he/she sells/ buys products/ services only in accordance with any applicable laws and regulations. The mere fact that a natural or legal person trades through our online trading platform does not provide evidence of legitimacy for the supply or sale/ purchase of products/ services. If the User doubts the legality of the supply or sale/ purchase of products/ services, he/ she should not continue the trading operation.
COMMISSION
The Administration will charge the Seller a fee ("Commission") for the use of the trading platform and the publication of his/her products. Seller is responsible for all fees and applicable taxes associated with the use of the trading platform.
Fees may change from time to time. The User is responsible for verifying this information on the site himself/herself.
The User agrees to pay the fees and other amounts required by this Agreement, within the prescribed period of time. If the due date is late, additional late fees may apply.
Users, both seller and buyer, must indicate the payment methods used in transactions with their products when trading on the site.
When purchasing a digital object offered by the Seller, the Buyer pays its purchase price in accordance with the rates indicated by the Seller for the posted item (s).
If the publication of products/ services or the Account is terminated by any of the Parties, the Seller is still obliged to pay all amounts due to the Administration. If the Seller does not pay in full, the Administration may apply additional fees and other fines and actions, including lawsuits.
TAXATION
The User is responsible for registering, reporting and paying all applicable taxes related to his/her business activity.
Taxes are collected and paid by any Party in accordance with applicable law.
INDEPENDENT CONTRACTORS
Each Party acts solely as an independent contractor, and nothing in these Terms shall be construed as giving any Party the authority or authority to act on behalf of the other Party, bind it or incur obligations in any way. Nothing in this document should be construed as creating a partner, principal and agent relationship or joint venture partners between the Parties.
The Administration will not enter into any contracts or obligations on behalf of the User. The Administration does not have the right to own or control any products/ services, but only provides the platform of the trading platform. The parties are independent contractors.
RESPONSIBLE PARTY
The selling User is the sole responsible party to the purchasing User in relation to the products/ services and/ or their functionality.
Users will in no way declare that the Administration is the guarantor or the responsible party for the listed goods, or otherwise involve the Administration in disputes between the user or a third party related to the transaction, delivery or functionality of the goods.
RIGHTS AND OBLIGATIONS OF THE USER
The User is solely responsible for the content of his/her ads on the trading platform and full compliance with the binding laws and regulations of the country (s) in which the User (s) operates.
The User is solely responsible for the content, correctness of advertising and its compliance with the requirements of these Terms and applicable law.
Seller's products listed on the trading platform must include the following information:
-Product availability;
-Price (including terms of delivery and payment);
-Name/ trade name;
-The main characteristics of the item, such as, for example, the name of the item, trademark, volume, etc.;
-Terms/ Policy of Delivery;
-Terms/ Policy of Return;
-Warranty obligations;
-The procedure for receiving and considering complaints;
-Other mandatory conditions (such as purchase conditions, etc.)
TERMINATION OF AGREEMENT
These Terms are effective from the date of acceptance of these Terms and until either Party terminates them by written notice by email. The User may terminate these Terms and Conditions and the Account at any time after written notice.
